1. The service

Migraine Today ("the Service") is a personal migraine and headache diary operated by Sintija Birgele. It helps you record symptoms, triggers, medication, cycle data, and lifestyle factors, and review patterns in your own data over time. By creating an account or using the Service, you agree to these Terms and to the Privacy Policy.

2. Medical disclaimer

Migraine Today is unofficial, non-certified software. It is not a medical device, has not been reviewed or cleared by any medical regulator, and does not diagnose, monitor for a medical purpose, predict, treat, or alleviate any disease or condition. Everything in the Service — your logged entries, the Learn/blog articles, prevention insights, cycle-phase estimates, and any pattern or correlation shown in your history — is a personal record-keeping and self-organization aid only. None of it is medical advice, and none of it is validated against clinical outcomes.

Migraine Today must only be used alongside, and never as a substitute for, care from a licensed physician. Always consult a doctor before making any medical or treatment decision, including starting, stopping, or changing any medication or supplement — regardless of what your logged history appears to show. If you experience a sudden, severe, or unusual headache, or any symptom that concerns you, seek emergency medical care immediately; do not use this app, or wait to consult it, in place of that.

This disclaimer applies regardless of your location — it is not limited to the EU statements in Section 3 below.

3. Not a medical device

Under EU Regulation 2017/745 (the Medical Device Regulation, "MDR"), software only qualifies as a medical device if it is intended by its manufacturer for a specific medical purpose — diagnosis, prevention, monitoring, prediction, prognosis, treatment, or alleviation of disease (Art. 2(1) MDR; MDCG 2019-11). Migraine Today is manufactured and intended exclusively for personal lifestyle and wellness record-keeping, and makes no diagnostic, prognostic, or treatment claim about any individual user. On that basis, Migraine Today is not medical device software (MDSW) and is not CE-marked under the MDR. Outside the EU — including under U.S. FDA policy for general wellness software — the same intended-use limitation applies: Migraine Today is not marketed, reviewed, or cleared as a medical device or diagnostic tool anywhere.

If a future version of the Service were ever intended for a medical purpose, that would be announced separately and would not take effect until any required regulatory clearance was obtained.

4. Eligibility & accounts

You must be at least 16 years old to create an account. Certain optional features (e.g. sexual-activity tracking and related content) are additionally restricted to users 18 and older, based on the birth date on your account, and are hidden entirely below that age rather than shown in a limited form.

You're responsible for the accuracy of the account information you provide and for keeping your login credentials confidential. Notify us immediately if you suspect unauthorized access to your account.

5. Acceptable use

You agree not to:

  • Use the Service for anyone's health data other than your own, without that person's consent;
  • Attempt to access another user's account or data;
  • Reverse-engineer, scrape, or interfere with the Service's normal operation;
  • Upload content you don't have the right to upload (e.g. someone else's private messages or financial records without their consent).

6. Your content & our content

You own the diary entries, notes, and files you provide. We process them to operate the Service for you, as described in the Privacy Policy, and don't sell it or use it to train third-party models. You can export or request deletion of your data at any time.

The Migraine Today name, design, Learn/blog articles, and underlying software are owned by Sintija Birgele and may not be copied or redistributed without permission.

7. Third-party imports

Conversation Analysis and Cost Statement let you optionally upload a chat export or bank statement to help fill in your diary. Conversation Analysis is parsed entirely in your browser and the raw text is never uploaded. Bank statement PDFs are parsed on our server solely to extract the transaction data you choose to apply to your diary; we don't retain the original PDF beyond processing it. You're responsible for having the right to upload any file you provide.

8. Liability

The Service is provided "as is," without warranty of any kind, including any warranty of accuracy, completeness, or fitness for a particular purpose. To the maximum extent permitted by law, Sintija Birgele is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

In particular, and without limiting the above: Sintija Birgele is not liable for any medical or treatment decision you or a third party makes based on data, insights, or content in the Service — see Sections 2–3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent, gross negligence, injury to life, body, or health, or under mandatory product-liability law.

9. International use

The Service is operated from Germany and designed around EU data protection law. If you access it from outside the EU/EEA, you do so on your own initiative and are responsible for compliance with your local laws; nothing here is intended to solicit use from a jurisdiction where the Service would be unlawful.

Nothing in these Terms limits any right you have under mandatory local consumer protection, health-data, or privacy law that cannot be waived by agreement — including, where applicable, rights under U.S. state privacy laws or other non-EU frameworks. Where such a mandatory right conflicts with a provision here, the mandatory right controls for that provision only.

10. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate accounts that violate Section 6 (Acceptable use) or applicable law, with notice where reasonably possible.

11. Governing law

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence within the EU.

12. Changes to these terms

We may update these Terms as the Service evolves. Material changes will be announced in-app before they take effect. Continued use after a change takes effect constitutes acceptance of the updated Terms.
